Съдебната власт в Република България е съставена от съда, прокуратурата и следствените служби. Съгласно Закона засъдебната власт, Висшият съдебен съвет(ВСС), e постоянно действащ орган, койтопредставлява съдебната власт и осигуряванейната независимост. Председателите наВърховния касационен и на Върховнияадминистративен съд, и Главниятпрокурор са по право негови членове.Заседанията на ВСС се председателстватот министъра на правосъдието и сапублични. Съдиите, прокурорите иследователите се назначават,повишават, понижават, преместват иосвобождават от длъжност от ВСС.Инспекторатът към ВСС наблюдаваорганизацията на административнатадейност на органите на съдебната власт.Правораздаването се осъществява отВърховния касационен съд, Върховнияадминистративен съд, апелативни,окръжни, административни, военни ирайонни съдилища. Съдебнотопроизводство по граждански инаказателни дела е триинстанционно, апо административни дела едвуинстанционно. Структурата наПрокуратурата е в съответствие с тази насъдилищата. Главният прокуроросъществява надзор за законност иметодическо ръководство на дейносттана всички прокурори. Следственитеоргани осъществяват разследване понаказателни дела в случаите, предвидени взакона.
The Bulgarian Judiciary is composed ofthree separate systems: a) the system ofcourts, b) the system of public prosecution,and c) the system of investigative offices. Itis administered by the Supreme JudicialCouncil (SJC), which consists of 25 members,of whom 11 are elected within the Judiciary,11 by the National Assembly and 3(The Chairman of the Supreme Court ofCassation, The Chairman of the SupremeAdministrative Court and the ProsecutorGeneral) who are sitting on it ex officio. Thesessions of the SJC are chaired by the Ministerof Justice and are open to public scrutiny.Justices, prosecutors and investigatingmagistrates are appointed, promoted,reduced in rank or position, reassigned orrelieved from office by the Supreme JudicialCouncil. The Inspectorate at the SupremeJudicial Council monitors the functioning ofjudicial authorities without infringing theirindependence. Jurisdiction in Bulgaria isexercised by the Supreme Court of Cassation,the Supreme Administrative Court, courts ofappeal, district courts, administrative courts,military and regional courts. Judicialproceedings are three-instance for civil andcriminal cases and two-instance for administrativecases. The structure of Public Prosecutionfollows that of the courts. The ProsecutorGeneral supervises the accurate anduniform application of the law and providesmethodological guidance to all subordinateprosecutors. Investigating magistrates carryout preliminary investigation in the criminalcases as specified by law.
