The capacity of both natural and legal persons to effectuate binding amendments to their civil or human rights, duties and obligations, e.g. getting married, entering into valid contracts, or making wills, is an aspect of their legal status and is defined in common law jurisdictions under the law of persons. Occasionally, standardised classes of persons have temporary or permanent restrictions imposed on standardised legal capacities (e.g. to marry, to acquire real property, to consume alcohol) for justified reasons. This condition is seen as “lack of a particular legal capacity” or overall “incapacity”. There may be different reasons for incapacitation some of them being: infancy, insanity, bankruptcy, etc.
